Terms of Use and End User Licence Agreement

These Terms of Use (the “Terms”) form a binding agreement between you and Global Technology Service Providers LLC, an Arkansas limited liability company (“GTSP”, “we”, “us”), governing your use of the My True Bible Companion mobile application, the Jeremiah voice companion, and this website (together, the “Service”). They also serve as the End User Licence Agreement for the app.

Please read section 10 (What the Service is not) and section 13 (Limitation of liability) carefully. By creating an account or using the Service you accept these Terms. If you do not accept them, do not use the Service.

1. Eligibility

You must be at least 13 years old to create an account. If you are under the age of majority where you live, you may use the Service only with the consent and involvement of a parent or legal guardian who agrees to be bound by these Terms on your behalf. You must provide accurate information when you register and keep it current.

2. What the Service is

My True Bible Companion connects you by voice to Jeremiah, an automated biblical companion. Jeremiah answers questions about Scripture, offers prayer and provides comfort, drawing on a knowledge base consisting of the complete King James Version of the Holy Bible — 66 books, 1,189 chapters and 31,102 verses.

Jeremiah is instructed to quote only from that text, to state the book, chapter and verse, and to decline rather than invent a passage it cannot find. Jeremiah is an automated system, not a person, and does not claim to be one.

3. Licence granted to you

Subject to these Terms and to your account remaining in good standing, GTSP grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use one copy of the app on a device that you own or control, for your own personal, non-commercial use. This licence is governed by the Usage Rules of the app store from which you obtained the app.

You may not, and may not permit anyone else to:

• Copy, modify, translate, adapt or create derivative works of the app.
• Reverse engineer, decompile or disassemble the app, except to the extent that applicable law expressly permits it despite this restriction.
• Rent, lease, lend, sell, redistribute, sublicense or share access to the Service or your account.
• Remove or obscure any proprietary notice.
• Use the Service to build a competing product, or extract its content in bulk by automated means.

All rights not expressly granted are reserved by GTSP.

4. Your account

You register with an email address and a phone number. You are responsible for keeping access to that email account and phone secure and for all activity under your account. Accounts are personal to you and must not be shared. Tell us at johnd@mybiblecompanion.app immediately if you believe your account has been used without your permission.

5. Free trial, subscriptions, prices and minutes

Beyond the free trial described below, access to voice sessions requires a paid, auto-renewing monthly subscription purchased inside the app. The tiers are:

Prices shown are in US dollars for the United States storefront. In other countries the price is the equivalent set by Apple's or Google's local pricing for that storefront, including any applicable taxes, and is displayed to you before you confirm the purchase.

First Light — the free trial

• First Light gives you 5 minutes of voice session time at no charge. No payment method is required and no subscription is created.
• It is offered once, and once only. The 5 minutes are a single grant. They are not a recurring monthly allowance, they do not reset, they do not renew, and they are not replaced when they are used up.
• One trial per verified phone number, and one per person. You must verify a phone number to receive it. A phone number that has already been used for a First Light trial — on any account — will not receive another.
• Attempting to obtain more than one trial — by creating additional accounts, by using additional, virtual, disposable or borrowed phone numbers, or by any other means — is a breach of section 9 and may result in suspension or termination.
• The trial has no cash value, cannot be transferred, exchanged or refunded, and does not expire into credit. We may withdraw or change the trial at any time for users who have not yet claimed it.
• When your trial minutes are used, voice sessions stop until you purchase a subscription.

How subscription minutes work

• Your plan's minutes are credited at the start of each monthly billing period.
• The duration of each voice session is deducted from your balance.
• Unused minutes do not roll over to the following month.
• When your balance reaches zero, voice sessions stop until your plan renews. You may upgrade to a higher plan or purchase additional minutes from within the app.
• Additional minutes purchased separately are a one-time purchase, not a subscription, and are consumed in the same way.

6. Billing, auto-renewal and cancellation

7. Refunds

Refunds are handled by Apple and Google, not by us. Because they are the merchants of record for in-app purchases, GTSP cannot issue, approve or reverse a charge.

• Apple: request a refund at reportaproblem.apple.com. Refunds are at Apple's discretion under the Apple Media Services Terms and Conditions.
• Google Play: request a refund through the Google Play Store or Google Play support, subject to Google's refund policies.

Except where the law requires otherwise, payments are non-refundable and there is no refund or credit for a partly used period, for minutes left unused, or for periods during which you did not use the Service. Nothing in these Terms limits any statutory right you may have. Consumers in the European Union and the United Kingdom have a statutory right of withdrawal for digital services, which may be lost once the service has begun with your consent; such requests are still processed through the store you purchased from.

8. Changes to prices and plans

We may change subscription prices or what a plan includes. A price increase applies from your next renewal, and you will be notified in advance in the way Apple or Google requires, including the opportunity to accept the new price or cancel. If you do not agree, cancel before the renewal date.

9. Acceptable use

You agree not to use the Service to:

• Break any law, or encourage anyone else to.
• Harass, threaten, defame or abuse any person, including through what you say in a session.
• Attempt to gain unauthorised access to the Service, other accounts, or our systems or those of our providers.
• Interfere with, overload, probe or disrupt the Service, or circumvent metering, authentication or usage limits.
• Obtain, or attempt to obtain, more than one First Light free trial — for example by registering multiple accounts, or by using virtual, disposable, borrowed or reassigned phone numbers to defeat phone verification.
• Use automated means to place sessions, resell access, or operate the Service on behalf of third parties.
• Impersonate another person, or misrepresent your affiliation with anyone.
• Attempt to make Jeremiah produce content that misrepresents Scripture, or present Jeremiah's output as the work or endorsement of a church, minister or religious body.

We may suspend or terminate access, with or without notice, if we reasonably believe these Terms have been broken or that the Service is being misused.

10. What the Service is not

Jeremiah is an automated system and can make mistakes, including in explanation, emphasis or application. It is built to quote only what the King James text says and to decline rather than invent, but no automated system is infallible. Always check a quoted reference against your own Bible, and take questions of doctrine to your own church. Jeremiah's explanations are plain explanation, not scholarship, and are not the doctrine of any denomination.

11. Privacy and recording

Voice sessions are not recorded. We do not create or store audio recordings or transcripts of your conversations. The voice platform is configured to retain basic call metadata only — when a session started and ended, how long it ran, and the minutes it consumed for billing.

The app does use Google Analytics for Firebase, which collects app usage and device and diagnostic data. Your phone number is used both to sign you in and to enforce the one-trial-per-number limit described in section 5. Our Privacy Policy explains all of this in full and forms part of these Terms.

12. Intellectual property

The app, the Jeremiah persona, our name, logo and all software, text, audio and design in the Service are owned by GTSP or its licensors and are protected by intellectual property law. The text of the King James Version of the Holy Bible is in the public domain in the United States. You may share what Jeremiah tells you with others; you may not reproduce the app or its underlying materials.

13. Disclaimer of warranties and limitation of liability

The Service is provided “as is” and “as available”, without warranty of any kind. To the fullest extent permitted by law, GTSP disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the Service will be uninterrupted, timely, secure, error-free, or that any statement made in a session will be accurate or complete.

To the fullest extent permitted by law, GTSP and its members, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill, or emotional or spiritual distress, arising out of or relating to your use of, or inability to use, the Service — whether based in contract, tort, strict liability or any other theory, and even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amount you paid for the Service in the twelve months before the event giving rise to the claim, or (b) fifty US dollars (US$50).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those places the exclusions and limitations above apply only to the extent permitted, and nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.

14. Indemnity

You agree to indemnify and hold harmless GTSP and its members, officers and employees from any claim, loss, liability or expense (including reasonable legal fees) arising out of your misuse of the Service, your breach of these Terms, or your violation of any law or of the rights of any third party.

15. Terms that apply because of Apple and Google

These Terms are between you and GTSP only, not with Apple Inc. or Google LLC. Where you obtained the app from the Apple App Store, the following also apply:

• Apple has no obligation to furnish any maintenance or support for the app. All support is provided by GTSP at johnd@mybiblecompanion.app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
• GTSP, not Apple, is responsible for addressing any claim relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• GTSP, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that the app infringes that third party's intellectual property rights.
• You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms of agreement when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

Where you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service, and Google is not a party to these Terms and bears no responsibility for the app.

16. Suspension and termination

You may stop using the Service at any time by cancelling your subscription through your store account settings and deleting your account — see Delete your account. We may suspend or terminate the Service, or your access to it, for breach of these Terms, for suspected fraud or abuse, or if we discontinue the Service. If we discontinue the Service entirely we will give reasonable notice. Sections 12 to 14 and 17 survive termination.

17. Governing law and disputes

These Terms are governed by the laws of the State of Arkansas, United States, without regard to its conflict-of-laws rules. You and GTSP agree to the exclusive jurisdiction of the state and federal courts located in Phillips County, Arkansas, and waive any objection to venue there. If you are a consumer resident in the European Union or the United Kingdom, this does not deprive you of the protection of the mandatory consumer laws of your country of residence or of your right to bring proceedings in your local courts.

Before starting any formal proceeding, please contact us at johnd@mybiblecompanion.app so we can try to resolve the matter directly. Most problems can be settled that way.

18. Changes to these Terms

We may update these Terms. When we do, we will change the “last updated” date at the top and post the revised Terms at this address. For material changes we will give notice in the app or by email to the address on your account before the change takes effect, and where a change affects an active subscription it will not apply before your next renewal. Continuing to use the Service after a change takes effect means you accept the revised Terms. If you do not accept them, cancel your subscription and stop using the Service.

19. General

If any provision of these Terms is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and GTSP regarding the Service.
